South Dakota Local Land-Use Sovereignty and State Authorization Act

No state agency, department, board, or employee shall implement, enforce, or expend state funds to assist in the execution of any new federal land-use or environmental directive, rule, guidance, or program affecting agricultural land, grazing, water use, or private property within South Dakota unless such cooperation is expressly authorized by an act of the Legislature or required by a final order of a court of competent jurisdiction. Each state agency shall continue to perform duties required under existing state law, but shall prioritize state and local control, protect private property rights, and submit any request for participation in new federal land-use or environmental initiatives to the Legislature for approval.
