South Dakota Land and Water Federal Coordination Act

This Act provides that any major federal rule, permit condition, funding requirement, or land- and water-use policy affecting South Dakota farms, ranches, or rural infrastructure may be implemented by a state agency only after consultation with and written approval from the Governor and the Legislature. The Governor shall establish a public review process, including notice to affected counties and landowners, and may direct the Attorney General to challenge federal actions that exceed federal authority or substantially impair state property rights. Nothing in this Act prevents federal agencies from exercising powers granted by the United States Constitution or federal law.
