This Act requires state agencies and local law-enforcement agencies, when making a lawful custodial arrest, to use available federal databases to verify an individual’s immigration status and, when appropriate, notify and coordinate with federal immigration authorities in accordance with federal law. No agency may delay necessary medical care or emergency services, and status verification may not be based solely on race, ethnicity, language, or national origin. Individuals shall receive notice of any immigration-related hold or transfer and retain all applicable due-process rights, including access to counsel and judicial review.
