This Act requires the Department of Homeland Security, in coordination with the Department of Justice, to provide designated state law-enforcement authorities with timely notice when a noncitizen who is unlawfully present and accused of a serious criminal offense is detained, transferred, or released from federal custody, including the individual’s custody status, scheduled court proceedings, and any applicable release conditions. Information shall be shared only for legitimate public-safety and case-management purposes, consistent with federal privacy law, and shall not be treated as proof of guilt or grounds for detention absent lawful authority. Nothing in this Act alters access to counsel, immigration hearings, criminal proceedings, or other constitutional and statutory due-process protections.
