Status: HopperSession: November 2026 Senate SessionIssue: States Rights

Summary

The bill restricts federal interference with state emergency and infrastructure decisions unless legally authorized or needed for national security, constitutional rights, or public safety. It also requires state consultation, written justification, and minimally restrictive interventions while preserving key federal powers.

Full text

This Act would limit federal agencies from preempting or conditioning federal assistance on state emergency-response protocols or infrastructure priorities unless such action is expressly authorized by law, necessary to address a declared national-security threat, or required to protect constitutional rights and public safety. Federal agencies must consult with affected state officials, provide written justification for significant interventions, and use the least restrictive means available, while preserving federal authority over defense, cybersecurity of federal systems, interstate emergencies, and the administration of lawful disaster assistance.
