Governor David Acton has signed Texas Iryna’s Law, aimed at tightening pretrial release policies for violent offenders and addressing mental health risks in Texas.

AUSTIN – Governor David Acton has signed Texas Iryna’s Law, a significant piece of legislation designed to strengthen public safety by limiting the pretrial release of dangerous criminals and repeat offenders. The law also addresses mental health concerns that may pose risks to Texas communities. In a statement, Governor Acton emphasized the need for the law, saying, “Too many Texans have suffered because dangerous individuals with violent histories or serious mental illness were released back onto our streets without proper safeguards.” He added that the legislation prioritizes public safety by implementing stricter measures for those charged with violent felonies. The law introduces several key reforms: 1. **Restrictions on Unsecured Release**: The legislation prohibits or severely limits the use of personal bonds and cashless bail for individuals charged with violent felonies, including murder, aggravated assault, sexual assault, and robbery. It mandates secured bail or strict conditions for these cases. 2. **Enhanced Judicial Oversight**: Under the new law, magistrates are required to provide written justifications for their release decisions. Prosecutors will have increased input, and district judges will review high-risk cases. Non-compliance with these procedures could lead to disciplinary actions against magistrates. 3. **Mandatory Mental Health Evaluations**: Courts are now required to order prompt mental health evaluations for defendants charged with violent offenses when mental illness may present a risk. If certain criteria are met, judges can order temporary involuntary commitment to ensure public safety until the trial. The law is named in honor of victims like Iryna Zarutska, whose death underscored the shortcomings of previous pretrial policies. Governor Acton stated that the legislation aims to protect innocent families and hold criminals accountable. Texas Iryna’s Law is set to take effect this month, marking a significant shift in the state's approach to pretrial releases and public safety.
