119th CONGRESS
2nd Session
H.R. 032

To repeal the limitation on the construction of new public housing, known as the Faircloth Amendment, and for other purposes.

IN THE SENATE OF THE UNITED STATES
Q2, 2026
Ms. O'Hare (for herself and others, with thanks to Ms. Ocasio-Cortez) introduced the following bill;

A BILL
To repeal the limitation on the construction of new public housing, known as the Faircloth Amendment, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.

This Act may be cited as the “Repeal the Faircloth Amendment Act”.

SEC. 2. Repeal of Faircloth amendment.

Section 9(g) of the United States Housing Act of 1937 (42 U.S.C. 1437g(g)) is amended by striking paragraph (3) (relating to limitation on new construction).

PES:

This bill repeals the limitation on the construction of new public housing units, commonly known as the Faircloth limit or the Faircloth amendment. Under current law, a public housing agency (PHA) is generally prohibited from using Department of Housing and Urban Development capital or operating funds to construct public housing units if doing so would result in a net increase to the number of public housing units owned, assisted, or operated by the PHA.
